Welcome to PicOnTshirt B.V.. By accessing our website, placing an order, or using our services, you agree to be bound by the following Terms of Service. Please read them carefully before making a purchase.

1. General Provisions & Contract Formation

• Eligibility: By placing an order, you represent that you are at least 18 years old or accessing the site with the consent of a legal guardian.
• Contract Formation: An order placed on our website constitutes an offer to purchase. A binding purchase contract is formed only when we process your order and dispatch an order confirmation/shipping email.
• Order Acceptance: We reserve the right to decline or cancel any order for reasons including, but not limited to, product unavailability, pricing/typographical errors, or potential intellectual property violations.

2. User Content & Intellectual Property Rights

When you upload or submit graphics, logos, photos, designs, or text for custom printing, you acknowledge and agree to the following terms:

• Ownership Guarantee: You warrant that you hold all necessary copyrights, trademarks, and legal ownership rights for any content submitted, or that you have obtained explicit written authority from the copyright holder to reproduce the content.
• Indemnification: You agree to fully indemnify, defend, and hold harmless PicOnTshirt B.V., its directors, and employees against any legal claims, proceedings, liabilities, damages, costs, or legal fees arising from third-party trademark, copyright, or intellectual property infringement claims connected to your submitted content.
• Right of Refusal: PicOnTshirt B.V. reserves the right to cancel and refund any order containing content deemed unlawful, hateful, defamatory, or infringing upon third-party intellectual property rights.

3. Product Specifications & Manufacturing Tolerances

• Color Disclaimer: Due to screen display variations (RGB format) and direct garment textile printing processes (CMYK format), slight variations between display colors and physical print results may occur. Minor color variations fall within accepted manufacturing standards.
• Sizing Tolerances: In accordance with standard textile production guidelines, garment dimensions provided on product size guides are subject to an industry-standard manufacturing tolerance of +/- 1.5 cm to 2.5 cm (0.5 to 1.0 inches).

4. Pricing, Payments & Taxes

• Pricing: All prices displayed on the website are in Euros (€) and include applicable statutory Value Added Tax (VAT / BTW).
• Payment Terms: Orders must be paid in full at checkout via our authorized payment service providers.
• Adjustments: We reserve the right to correct typographical errors or price inaccuracies prior to order processing.

5. Shipping & Delivery

Delivery dates are estimated and do not constitute binding deadlines. PicOnTshirt B.V. shall not be held liable for shipping delays caused by carrier disruptions, customs procedures, or inaccurate address details submitted by the customer.

6. Returns, Refunds & Cancellation

Cancellation terms, standard return eligibility, and exceptions regarding custom-printed items are detailed in our Return & Refund Policy, which is incorporated by reference into these Terms of Service.

7. Limitation of Liability

To the fullest extent permitted by law, PicOnTshirt B.V. shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our services or products. Total liability for any claim shall not exceed the net purchase amount of the specific order in question.

8. Governing Law & Jurisdiction

These Terms of Service and all related agreements shall be governed exclusively by the laws of the Netherlands. Any disputes arising out of or in connection with these terms shall be submitted exclusively to the competent courts of Rotterdam, the Netherlands.
